This is the Privacy Policy Notice for UCR Filings Co (“fmcaportal.com”). UCR Filings Co, along with its affiliates and joint ventures, provides services in the transportation industry, including Department of Transportation (DOT) compliance services (referred to throughout as “Services”). UCR Filings Co collects personal information from Customers (referred to throughout as “Customer”, “you”, “your”, and or “user”) and visitors through our website and services, (collectively referred to throughout as “the Platform”) and in connection with UCR Filings Co's Services. This Privacy Policy explains how and why UCR Filings Co might ("UCR Filings Co," "we," "us," or "our") use, collect, store and/or share your information when you access the Platform or use our Services, as well as the choices you have regarding it and how you can contact UCR Filings Co with any questions or concerns. 1. TYPES OF INFORMATION UCR Filings Co COLLECTS - UCR Filings Co collects personal information that you provide to UCR Filings Co when you register on the Platform, provide UCR Filings Co with your USDOT Number, express an interest in obtaining information about UCR Filings Co or about UCR Filings Co's products and Services, when you participate in activities on the Platform, when you subscribe for our Services, or when you otherwise contact UCR Filings Co. The personal and company information that UCR Filings Co collects depends on the context of your interactions with UCR Filings Co, the Services selected, the selections you make, the options you exercise and the features you use. The personal information UCR Filings Co collects may include the following:

  • a. Name and phone numbers
  • b. Email, billing, and mailing addresses
  • c. Job and company titles
  • d. Usernames and passwords
  • e. Contact preferences, contact and authentication data
  • f. Debit card and credit card numbers
  • g. USDOT number and company name
  • h. Driver's license number and vehicle tag number

All personal, billing, and company information that you provide to UCR Filings Co must be true, complete, and accurate, and you must notify UCR Filings Co of any changes to such personal and company information. UCR Filings Co is not responsible for the consequences of the provision of incorrect, incomplete, or fraudulent information.

2. INFORMATION AUTOMATICALLY COLLECTED - UCR Filings Co automatically collects certain information when you visit, use, or navigate the Platform. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use the Platform, and other technical information. This information is primarily needed to maintain the security and operation of the Platform and our Services, and for our internal analytics and reporting purposes. The types of information UCR Filings Co collects includes:

a. Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use the Platform and which UCR Filings Co record in log files. Depending on how you interact with UCR Filings Co, this log data may include your IP address, device information, browser type, and settings and information about your activity on the Platform (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports ("crash dumps"), and hardware settings).

c. Location Data. UCR Filings Co collects location data such as information about your device's location, which can be either precise or imprecise. How much information UCR Filings Co collects depends on the type and settings of the device you use to access the Platform. For example, UCR Filings Co may use GPS and other technologies to collect geolocation data that tells UCR Filings Co your current location (based on your IP address). You can opt out of allowing UCR Filings Co to collect this information either by refusing access to the information or by disabling your Location setting on your device. However, if you choose to opt out, you may not be able to use certain aspects of the Platform.

3. PROCESSING OF INFORMATION - UCR Filings Co processes your personal information for a variety of reasons, depending on how you interact with the Platform, including:

  • a. To enable you to create, authenticate, and log in to your account.
  • b. To manage and keep your account in working order.
  • c. To fulfill and manage your orders and to provide the requested Service(s).
  • d. To respond to inquiries and solve any potential issues with the Service(s).
  • e. To send you details about our Services, changes to our terms and policies, and other similar or administrative information.
  • f. UCR Filings Co processes your USDOT number to obtain available information from the U. S. Department of Transportation website.
  • g. To process payments and returns made through the Platform.

4. LEGAL BASES ACCORDING TO JURISDICTION - If you are located in Canada, this section applies to you. UCR Filings Co may process your information if you have given UCR Filings Co specific permission (i.e., express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (i.e., implied consent). You can withdraw your consent at any time. In some exceptional cases, UCR Filings Co may be legally permitted under applicable law to process your information without your consent, including, for example:

  • a. If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way.
  • b. For investigations and fraud detection and prevention.
  • c. For specified business transactions provided certain conditions are met.
  • d. If it is contained in a witness statement and the collection is necessary to assess, process, or settle an insurance claim.
  • e. For identifying injured, ill, or deceased persons and communicating with next of kin.
  • f. If UCR Filings Co has reasonable grounds to believe an individual has been, is, or may be victim of financial abuse.
  • g. If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province.
  • h. If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records.
  • i. If it was produced by an individual in the course of their employment, business, or profession and the collection is consistent with the purposes for which the information was produced.
  • j. If the collection is solely for journalistic, artistic, or literary purposes.
  • k. If the information is publicly available and is specified by the regulations.

5. SHARING INFORMATION - UCR Filings Co may share your personal information in the following situations:

  • a. Business Transfers. UCR Filings Co may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • b. Affiliates. UCR Filings Co may share your information with our affiliates, in which case UCR Filings Co will require those affiliates to honor this privacy policy notice. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that UCR Filings Co control or that are under common control with UCR Filings Co.

THIRD-PARTY WEBSITES - The Platform and or Service(s) may link to third-party websites, online services, or mobile applications and/or contain advertisements from third parties that are not affiliated with UCR Filings Co, and which may link to other websites, services, or applications. Accordingly, UCR Filings Co does not make any guarantee regarding any such third parties, and UCR Filings Co will not be liable for any loss or damage caused by the use of such third-party websites, services, or applications. The inclusion of a link to a third-party website, service, or application does not imply an endorsement by UCR Filings Co. UCR Filings Co cannot guarantee the safety and privacy of data you provide to any third parties. Any data collected by third parties is not covered by this privacy policy notice. UCR Filings Co  is not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services, or applications that may be linked to or from the Platform. You should review the policies of such third parties and contact them directly to respond to your questions.

7. COOKIES AND OTHER TRACKING TECHNOLOGIES - UCR Filings Co may use cookies and similar tracking technologies (like web beacons and pixels) to access or store information. Specific information about how UCR Filings Co uses such technologies and how you can refuse certain cookies is set out in our Cookie Notice in 8.

8. INFORMATION RETENTION - UCR Filings Co will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). When UCR Filings Co has no ongoing legitimate business need to process your personal information, UCR Filings Co will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then UCR Filings Co will securely store your personal information and isolate it from any further processing until deletion is possible.

9. PROTECTION OF INFORMATION - UCR Filings Co has implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information UCR Filings Co processes. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so UCR Filings Co cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although UCR Filings Co will do our best to protect your personal information, transmission of personal information to and from the Platform is at your own risk. 10. NO COLLECTION OF INFORMATION FROM MINORS - You must be 18 years of age to use the Platform. UCR Filings Co does not knowingly solicit data from or market to minors under 18 years of age. By using the Platform, you represent that you are at least 18 years of age. If UCR Filings Co learns that personal information from users less than 18 years of age has been collected, UCR Filings Co will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data UCR Filings Co may have collected from a minor under the age of 18, please notify UCR Filings Co at or through the LiveChat feature on the Platform.

11. PRIVACY RIGHTS DEPENDING ON REGION - In some regions, you have certain rights under applicable data protection laws. No matter where you live, UCR Filings Co is committed to following all applicable data protection laws. If you believe you have additional privacy rights or protections, please contact UCR Filings Co by email at or via the LiveChat feature on the Platform so that UCR Filings Co can comply with all applicable laws.   • a. Withdrawing your consent: If UCR Filings Co is relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting UCR Filings Co at  or through the LiveChat feature on the Platform. However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.
  • b. Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the footer of the emails that UCR Filings Co sends or subscription renewal notice or by contacting UCR Filings Co at or through the LiveChat feature on the Platform. You will then be removed from the marketing lists. However, UCR Filings Co may still communicate with you — for example, to send you messages related to your Subscription(s) or Service(s) that are necessary for the administration and use of your account, to respond to Service(s) requests, or for other non-marketing purposes.
  • c. Account Information: If you would at any time like to review or change the information in your account or terminate your account, contact UCR Filings Co at orders@ or through the LiveChat feature on the Platform. Upon your request to terminate your account, UCR Filings Co will deactivate or delete your account and information from our active databases. However, UCR Filings Co may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.
  • d. Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or Service(s) of the Platform. You may also opt out of interest-based advertising by advertisers on the Platform by contacting UCR Filings Co at  or through the LiveChat feature on the Platform.

12. CONTROLS FOR DO-NOT-TRACK FEATURES - Most web browsers and some mobile operating systems and mobile applications include a Do Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, UCR Filings Co does not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that UCR Filings Co must follow in the future, UCR Filings Co will inform you about that practice in a revised version of this privacy policy notice.

13. CALIFORNIA RESIDENTS - California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits users who are California residents to request and obtain from UCR Filings Co, once a year and free of charge, information about categories of personal information (if any) UCR Filings Co disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which UCR Filings Co shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please contact UCR Filings Co at orders or through the LiveChat feature on the Platform.

UCR Filings Co does not permit use by minors, however, under California law, if you are under 18 years of age, reside in California, and have a registered account, you have the right to request removal of unwanted data that you publicly post on the Services. UCR Filings Co Services and the use of the Platform is not intended for minors, and upon learning or notification that a minor has registered an account, UCR Filings Co reserves the right to cancel and delete your account. To request removal of such data, please contact UCR Filings Co at  or through the LiveChat feature on the Platform and include the email address associated with the account and a statement that you reside in California. UCR Filings Co  make sure the data is not publicly displayed on the Platform, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g., backups, etc.).

  • a. CCPA Privacy Notice - The California Code of Regulations defines a "resident" as:
    • i. every individual who is in the State of California for other than a temporary or transitory purpose and
    • ii. every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose.
    • All other individuals are defined as "non-residents." If this definition of "resident" applies to you, UCR Filings Co must adhere to certain rights and obligations regarding your personal information.
  • b. Categories of personal information UCR Filings Co collects – California residents have the right to request that UCR Filings Co disclose the following information to you about our collection and use of your personal information over the past twelve (12) months. UCR Filings Co may ask you to provide certain information to identify yourself so that we may compare it with our records in order to verify your request.Upon verification, we will disclose to you:
    • i. The categories of personal information we have collected about you.
    • ii. The categories of sources for the personal information we have collected about you.
    • iii. The specific pieces of personal information we have collected about you.
    • iv. Our business or commercial purpose for collecting or selling your personal information.
    • v. The categories of third parties to whom we have sold or shared your personal information, if any, and the categories of personal information that we have shared with each third-party recipient.
  • c. UCR Filings Co may also collect other personal information outside of these categories through instances where you interact with UCR Filings Co online, through LiveChat on the Platform, or by email in the context of receiving help through email at or through the LiveChat feature on the Platform; Participation in customer surveys or contests; and Facilitation in the delivery of our Services and to respond to your inquiries.
  • d. Authorized Agents and Verification Requirements - If you are using an authorized agent to exercise your right to opt out, UCR Filings Co may deny a request if the authorized agent does not submit proof that they have been validly authorized to act on your behalf.
  • e. When your information may be shared - UCR Filings Co may disclose your personal information with our service providers pursuant to a written contract between UCR Filings Co and each service provider. Each service provider is a for-profit entity that processes the information on our behalf, following the same strict privacy protection obligations mandated by the CCPA. UCR Filings Co may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be the “selling" of your personal information. UCR Filings Co has not sold any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months.
  • f. Your right to request deletion of the data - You can ask for the deletion of your personal information. If you ask UCR Filings Co to delete your personal information, UCR Filings Co will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation, or any processing that may be required to protect against illegal activities.
  • g. Removal of Personal Information - In accordance with applicable law, UCR Filings Co is not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.
  • h. Non-Discrimination for the Exercise of Privacy Rights - UCR Filings Co will not discriminate against you if you exercise your privacy rights.
  • i. Verification process - Upon receiving your request, UCR Filings Co will need to verify your identity to determine you are the same person about whom UCR Filings Co has the information in our system. These verification efforts require UCR Filings Co to ask you to provide information so that UCR Filings Co can match it with information you have previously provided UCR Filings Co. For instance, depending on the type of request you submit, UCR Filings Co may ask you to provide certain information so that UCR Filings Co can match the information you provide with the information UCR Filings Co already has on file, or UCR Filings Co may contact you through a communication method (e.g., phone or email) that you have previously provided to UCR Filings Co. UCR Filings Co may also use other verification methods as the circumstances dictate.
  • j. UCR Filings Co will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, UCR Filings Co will avoid requesting additional information from you for the purposes of verification. However, if UCR Filings Co cannot verify your identity from the information already maintained by UCR Filings Co, UCR Filings Co may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. UCR Filings Co will delete such additionally provided information as soon as UCR Filings Co finishes the process of verifying your identity.
  • k. Other privacy rights
    • i. You may object to the processing of your personal information.
    • ii. You may request correction of your personal data if it is incorrect or no longer relevant or ask to restrict the processing of the information.
    • iii. You can designate an authorized agent to make a request under the CCPA on your behalf. UCR Filings Co may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.
    • iv. You may request to opt out from future selling or sharing of your personal information to third parties. Upon receiving an optout request, UCR Filings Co will act upon the request as soon as feasibly possible, but no later than fifteen (15) days from the date of the request submission.

14. NEVADA RESIDENTS - Under Nevada law, certain Nevada residents may opt out of the sale of “personally identifiable information” for monetary consideration to a person for that person to license or sell such information to additional persons. “Personally identifiable information” includes first and last name, address, email address, phone number, Social Security Number, or an identifier that allows a specific person to be contacted either physically or online. UCR Filings Co does not engage in such activity; however, if you are a Nevada resident who has placed orders for Service(s) from UCR Filings Co, you may submit a request to opt out of any potential future sales under Nevada law by emailing FMCA at  or through LiveChat on the Platform. Please note UCR Filings Co will take the requisite reasonable steps to verify your identity and the authenticity of the request. Once verified, UCR Filings Co will maintain your request in the event UCR Filings Co practices change.

15. VIRGINIA RESIDENTS - Virginia CDPA Privacy Notice - Under the Virginia Consumer Data Protection Act (CDPA):
"Consumer" means a natural person who is a resident of the Commonwealth acting only in an individual or household context. It does not include a natural person acting in a commercial or employment context.
"Personal data" means any information that is linked or reasonably linkable to an identified or identifiable natural person. "Personal data" does not include de-identified data or publicly available information.
"Sale of personal data" means the exchange of personal data for monetary consideration.

If this definition "consumer" applies to you, UCR Filings Co must adhere to certain rights and obligations regarding your personal data. The information UCR Filings Co collects, use, and disclose about you will vary depending on how you interact with UCR Filings Co and our Services. Your rights with respect to your personal data:

  • a. Right to be informed whether or not UCR Filings Co are processing your personal data.
  • b. Right to access your personal data.
  • c. Right to correct inaccuracies in your personal data.
  • d. Right to request deletion of your personal data.
  • e. Right to obtain a copy of the personal data you previously shared with UCR Filings Co.

UCR Filings Co does not "sell" personal information as that word is traditionally defined. However, FMCA does share personal information with third parties to provide personalized advertising. Through the use of cookies, certain personal information may be made available to third parties. This is the “targeting” that you may opt-out from under Virginia law.

Exercise your rights provided under the Virginia CDPA - You can opt out from the selling of your personal data, targeted advertising, or profiling by disabling cookies in Cookie Preference Settings. You may contact UCR Filings Co by email at or LiveChat on our Platform. If you are using an authorized agent to exercise your rights, UCR Filings Co may deny a request if the authorized agent does not submit proof that they have been validly authorized to act on your behalf.

Verification process - UCR Filings Co may request that you provide additional information reasonably necessary to verify you and your consumer's request. If you submit the request through an authorized agent, UCR Filings Co may need to collect additional information to verify your identity before processing your request. Upon receiving your request, UCR Filings Co will respond without undue delay, but in all cases, within forty-five (45) days of receipt. The response period may be extended once by forty-five (45) additional days when reasonably necessary.UCR Filings Co will inform you of any such extension within the initial 45-day response period, together with the reason for the extension.

16. UPDATES TO THIS PRIVACY POLICY NOTICE - UCR Filings Comay update this privacy policy notice from time to time. The updated version will be indicated by an updated "Revised" date and the updated version will be effective as soon as it is accessible. If UCR Filings Co makes material changes to this privacy policy notice, UCR Filings Co may notify you either by posting a notice of such changes or by directly sending you a notification. UCR Filings Co encourages you to review this privacy policy notice frequently to be informed of how UCR Filings Co is protecting your information.

17. REVIEW, UPDATE, OR DELETE THE DATA UCR Filings Co COLLECTS - Based on the applicable laws of your state or country of residence, you may have the right to request access to the personal information UCR Filings Co collects from you, change that information, or delete it. 18. EXCEPTIONS TO APPLICATION - Please note that this Privacy Policy does not apply to information provided to UCR Filings Co for employment or potential employment screening purposes, which is governed by the Fair Credit Reporting Act and other related statutes.

TYPES OF DATA COLLECTED - UCR Filings Co may collect information about your interactions with the Platform, such as the pages you visit, the links you click on, and the actions you take while using the Platform. This information may be used to improve the user experience, to analyze how the Platform is being used, and to personalize content and advertisements on the Platform. Additionally, UCR Filings Co may use various technologies to collect this information, including cookies and web beacons. 20. DATA SHARING - UCR Filings Co may share your personal information with UCR Filings Co's employees, independent contractors, representatives, agents, affiliates, corporate parent, subsidiaries, and any other affiliates for purposes consistent with this Privacy Policy.

21. STATISTICS - UCR Filings Co may share aggregated benchmarking statistics with Customers about drivers in the industry, such as the average number of years that drivers stay in the same position.

22. SERVICE PROVIDERS - UCR Filings Co may share your personal information with companies and individuals that provide services on UCR Filings Co's behalf or help UCR Filings Co operate UCR Filings Co's Services, the Platform or UCR Filings Co's business. This includes hosting and server co-location services, communications and content delivery networks (CDNs), data and cyber security services, billing and payment processing services, fraud detection, investigation and prevention services, web and mobile analytics, email and communication distribution and monitoring services, session or activity recording services, call recording, analytics and transcription services, event production and hosting services, remote access services, performance measurement, data optimization and marketing services, support and customer relation management systems, and third-party customer support providers.

23. THIRD PARTY COMPANIES - UCR Filings Co may share your personal information with third party advertising companies (including the interest-based advertising purposes described above), lead generation partners, and channel partners, resellers, and distributors that allow UCR Filings Co to explore and pursue growth opportunities.

24. PROFESSIONAL ADVISORS - UCR Filings Co may share your personal information with professional advisors, such as lawyers, auditors, bankers, and insurers, where necessary in the course of the professional services that they render to UCR Filings Co.
